Team VADA 2012 General Assembly Bill Tracking

 The 2012 Session of Virginia's General Assembly has gotten underway and Team VADA has another busy year ahead of us. Unlike previous sessions, where we have been driving legislation forward, this year we are fighting to hold our ground. Last year's victory was hard won and highly valuable, so it was critical that we commit ourselves to its defense. Please note that since we are not pushing a franchise bill this year, we will not host a legislative reception or “Assault The Hill” day.

Here at the Virginia Automobile Dealers Association we are turning our primary focus to several important issues that are affecting the auto industry in Virginia. We will continue to keep you updated on the legislation that will impact you and your business.

This 60 day session will include a docket of almost 2500 bills, including a two-year budget of more than $85 billion. This is a decrease in the number of bills from past long Sessions.

Motor Vehicle Transaction Recovery Fund

This bill includes:

  • Ensuring a balance between fund and the dealer bond
  • Dealer bond liable for attorneys fees
  • Allowing the Dealer Board to use $250,000 minumum balance in the fund to pay claims.

 Supplemental Sales Licenses
HB 235 (Cosgrove) 

 

This bill includes:

  • Enures consumers are protected from 'roving car sales'
  • Prohibits a consecutive license in the same locality while limiting a dealer to 8 licenses a year
  • Tightened requirements for notifying other dealers in area of a used car sale

This bill includes:

  • Extension of the qualification deadline for CTE schools to attain national certification until July 1, 2013

Electronic Titling

This bill includes:

  • Will permit DMV to put in place electronic titling.
  • Will hopefully eliminate the need for dealers to follow up with titles all over the country.

Temporary Tags

This bill includes:

  • Will change temp tag fee from $2 to $3 to pay for the increased cost of new material that will be used for print - on - demand temp tags.
  • No cost to dealers in this process

OTHER LEGISLATION

Team VADA is tracking and working numerous bills which could impact your business.  Below are a few of these bills.

Hybrids and HOV lanes: The exemption to the HOV passenger restrictions for hybrid vehicles with clean fuel plates expires on July 1, 2012. There has been legislation introduced to extend that exemption for an additional year, until July 1, 2013.This year the legislature is considering additional restrictions on the use of these tags.
 
Salvage Vehicles: Several measures have been introduced affecting disclosures related to salvage vehicles. We will work to ensure Virginia’s strong salvage laws are not weakened.
 
Emissions Inspections: Bills have been introduced that will impact the emissions inspections system in Northern Virginia.
 
Electronic Tracking Devices: This bill would prohibit anyone from using an electronic tracking device to track the location of another person. The penalty for the use of such devices is a Class 3 misdemeanor. We will work to ensure the bill does not impact dealer and lienholder business practices.
 
General Employer Related Items: We are also involved in several issues that impact all employers generally, including proposed increases in unemployment and workers comp obligations and verification of the legal work status of employees. There are always many different bills introduced that effect Virginia employers and we work with our colleagues representing many groups to ensure Virginia employers do not see their costs skyrocket.
